An exciting ruling for Medical Cannabis Lawyers came out of Eastern District of Washington. You can read coverage from other bloggers here. In short, the Judge held that medical cannabis is decriminalized and that a plain and ordinary reading of the statute provides protection from arrest and prosecution. You can read the defense motion here and the court’s ruling here. It was a bold argument made by defense counsel Richard Wall. It was also a sensible ruling by Judge Nielsen. The fact that it is a Federal case from Eastern Washington surprised us all. It is our understanding that the case is going to be appealed to up. In the meantime, we look forward to implementing these arguments in all our future briefing.
